Understand Your Rights Regarding Your Work Injury
Accidents in the workplace can occur at anytime, inflicting pain and financial hardship on the injured workers. If you want to get back in good health and to work after your personal injury, then you will need to understand your options as well as your rights.
There are many accidents that occur in the workplace including:
Repetitive strain injuries - Injuries that fall under this category are known as cumulative trauma disorders and include the common workplace injury of carpal tunnel syndrome. These injuries occur as a result of forceful repetitive motions involving the arms, wrists, and hands. Common symptoms of repetitive strain injuries include aching limbs, an inability to grip items, and a throbbing sensation in the afflicted area.
Slips and falls - Falling on the job can be caused by an obstructed view of the floor, a wet surface, loose carpeting or rugs, and items not being placed in their proper areas. Avoiding accidents in this area can be achieved through employee diligence and company enforcement of regulations. Keeping areas clean, securely affixing flooring and reporting any violations by employees to return items where they belong can help prevent many of these accidents.
Motor vehicle accidents - Company vehicles are often driven by employees and as result they can also be involved in work injuries. Following the speed limit, exercising caution, and only conducting company business while on company time, can prove highly effective in eliminating many accidents.
Do you qualify for work injury compensation?
You must meet the following qualifications in order to be able to file a work injury compensation claim:
Be a full-time employee - Workers compensation only covers employees that are full time. Part-time workers, contractors, freelancers, and other workers are not provided coverage.
File your work injury claim on time - Work injury claims have time limits and require that you turn in your claim within the legal time frame. If your claim is turned in after this time it can be rejected.
The injury had to have occurred at work - Workers compensation only covers injuries and illnesses that occur at the workplace, not in route to and from work, or anyplace that is offsite.
Seek medical care - Most employers and/or their insurance companies will require that you seek medical care from a doctor in order to assess your injury and to establish its origins. Even if this care is not required you should still seek medical attention for your own health.
